And a natural or legal person purchasing on the website http://publications.efeo.fr, named hereafter “the Buyer” or the “the Customer”

PREAMBLE

EFEO is a publisher of products content exclusively for consumers, sold through the website http://publications.efeo.fr.
A list and descriptions of the products proposed by EFEO can be consulted on the website.

Article 1: Contract’s object

The present general terms of sale apply to all the orders made through the website http://publications.efeo.fr. The general terms and conditions of sale state the rights and duties of the parties involved in the online sale of products proposed by EFEO. They can be modified at any time by EFEO, being specified that the version governing the order will be the one current on the date of this order.

Article 2: General provisions

The present general terms of sale apply to all products sold through the website that are an integral part of the contract between the Consumer and EFEO.

EFEO reserves the right to modify the terms and conditions of sale at any time, by publishing a new version on the website. The Terms and Conditions of sale applicable are those in effect on the day of actual payment of the order (or on the date of the first payment if several payments are made). EFEO assures that the acceptance of the Terms and Conditions of sale is clear and unconditional, by setting up a checkbox and a click of validation.

The Buyer declares to have read and accept, without restriction, nor reserve, the present General Terms and Conditions of Sale and, if need be, the particular conditions of sale concerning a product or a service. The Customer acknowledges that he has been provided with full advice and information in order to ensure that the offering is in line with his requirements. The Customer states that he is legally able to conclude a contract or to represent the natural or legal person on behalf of which he concludes the contract.

Unless proved otherwise, information registered by EFEO constitutes proof of all transactions.

Article 3: Price

The prices of products sold through the website are indicated in euros, exclusive of tax, and precisely determined on the pages describing the products. Prices are also given in Euro all taxes included (VAT + any other taxes) and shipping fees excluded, on the order page.

VAT rate applied:

  • 5.5 % to publications
  • 2.1 % to press publications
  • 20 % to multimedia products

All products shipped inside the UE and/or to the DOM/TOM are subject to VAT.

For all products shipped outside the UE or the DOM/TOM, prices are automatically calculated exclusive of tax on the bill. Customs duties or other local taxes, import duties or state taxes may be payable in certain cases. These duties and amounts are not the responsibility of EFEO. These duties and taxes are to be paid by the customer, who is entirely responsible as regards both declarations and payments. EFEO encourages the customer to get more information on these specific aspects with the relevant local authorities.

All orders, regardless of their provenance, are charged and payable in Euro. EFEO reserves the right to change prices at any time. Goods will be charged the price in force at the time the order is received.

Communication costs necessary to access EFEO publications website and EFEO website (http://www.efeo.fr/) are the responsibility of the customer. If applicable, the delivery costs are also the responsibility of the client.

Article 4: Conclusion of online contract

To realize his order, the Buyer must follow a set of specific steps for every product proposed by EFEO.

However, the steps described hereunder are systematic:

  • Information on essential features of the product
  • Choice of the product, where appropriate of its options and provision of personal data ( identification, address)
  • Agreement to these General Terms and Conditions of Sale
  • Check of the order details, where appropriate correction of the errors
  • Tracking of the instructions payment and payment of the products
  • Products delivery

The customer will then receive by email, a payment confirmation and a receipt confirmation of the order.

In case of delivery, the products are delivered at the address specified by the Customer               .

To ensure the good execution of the order, and under article 1316-1 to the French Civil Code, the Customer undertakes to provide authentic identifiers.

EFEO retains the possibility of refusing to follow up an order that is manifestly unreasonable, carried out in bad faith or for any other legitimate reason.

Article 5: Products and services

Essential features of the goods, services and their respective prices are available for the Buyer through the website. The customer certifies that he received the details of the delivery costs as well the conditions of payment, delivery and contract execution.

EFEO remains committed to fulfill the customer orders within the limits of available stock only. Failing that, EFEO will inform the Customer.

These contractual information’s are detailed in both French and English. According to the French law, they are subject to a summary and a confirmation during the order validation.

Both parties agree that illustrations and photography’s of the products on sale shall not have any contractual value.

The period for which the offer and the price will remain available is indicated on the EFEO website.

If the contract provides continuous or periodic supply of products and services, the minimum policy terms is also indicated on the EFEO publications website. Unless specific conditions, the rights are only granted to the natural person and signatory of the order (or the holder of the email communicated). In accordance with the relevant statutory provisions, EFEO reimburse or exchange defective products or products not corresponding to the order.

Beforehand, the buyer must give notice to EFEO about the return of the product and the reason of the return, by mail at EFEO Service Diffusion, 22 avenue du Président Wilson 75116 Paris, or by  email at efeo-diffusion@efeo.net. Then, he can return the product, kept in its original packaging, by tracked parcel. The return costs are the responsibility of the customer, the return must be made within the time frame prescribed by law. Bank details ( IBAN & BIC) must be provided to proceed with a reimbursement.

Once EFEO receives the returned product, the costs and the shipping fees will be re-credited on the Customer’s bank account, regardless of the payment method chosen to make the order.

After receiving the parcel, EFEO proceeds with the return of the new product.

Article 6: Retention of tittle arrangement

Products remain property of EFEO until full payment of the price.

Article 7: Delivery

Products are delivered to the shipping address provided through the order, within the period specified. This period shall not include the time taken to process the order.

If the delivery requires an appointment, the customer must contact the distribution service by phone at +33153 70 18 37, by fax at +33 1 53 70 18 38 or by email at efeo-diffusion@efeo.net.

When several products are ordered at the same time, they are shipped at one time.

If shipment is delayed, the Buyer will be informed of the delay and its reason by email.

If delivery is delayed, the Buyer can rescind the contract according to the terms and conditions defined in Article L 138-2 of the French Consumer Code. EFEO proceeds with the reimbursement of the product and shipping fees according to Article L 138-3 oh the French Consumer Code.

In order to ensure order tracking, EFEO runs a telephone line whose number is indicated on the order confirmation email. (International call costs may apply).

Once the Customer takes physical possession of the goods, the risk of loss or damage to the goods shall pass to him. It is for the Customer to notify the shipping company for any reservations on the delivered product.

Article 8: Availability

Orders will be processed within the limit of available product stock. In case of unavailability of an article during more than 5 working days, the Buyer will be informed of the new delivery deadlines. The order can be cancelled on simple request. The customer can ask for a credit note or a refund.

Article 9: Payment

The orders picked up at EFEO can be paid:

  • by cash, check or card, the day the order is being picked up
  • by check sent before picking up the order 
  • by card or money transfer through the website when making the order

Delivered orders can be payed immediately through the website by money transfer or by card, while the order is being made, or by check. If the order is paid by check, it will be shipped once the check is received by EFEO.

Payments by card (MasterCard, Visa): the Buyer must indicate the bearer’s card name, the card number, the three number of the cryptogram on the back of the card. Information must be filled into the fields provided. Cards issued by banks not domiciled in France must be international bank cards.

Secure online payment by credit card is processed by our payment provider: Ingenico ePayments.

The transmitted data is encrypted and cannot be read.

Once the Buyer has made the payment, the transaction is immediate and is sold within a 7 days period. According to Article L.132-2 of the Monetary and Financial Code, the commitment given through the payment by card is irrevocable.

By submitting his bank information during the sale, the Client authorize EFEO to debit from his account the amount corresponding to the price indicated.

The Customer states that he is the legal holder of the card, and that he is legally permitted to use it. In case of error, impossibility to debit the card, the sale is immediately declared canceled as of right.

If the payment is made by check, the check must be made in euros, payable in France in the name of EFEO Diffusion. Checks sent by mail must be sent to EFEO, 22 avenue du Président Wilson 75116 Paris.

Excepts for orders picked up and payed at EFEO, orders are only processed once the check has been received. Processing time may be extended depending on the time needed by the Post Office.

Article 10: Cancellation

Once the order is confirmed, it still can be canceled by the Customer within a 24 hours deadline. When the order is being processed, cancellation is no longer possible on the website

 After 24h, if the order has not yet be shipped, the Customer must ask for the refund of the order by contacting EFEO at +33 1 53 70 18 37 or through the contact form.

Once the order has been delivered, if the Customer wants to cancel his order, he must exercise his right of withdrawal as stipulated in Article 11.

Article 11: Right of withdrawal

Under article 121-18 of the French Consumer code, the Consumer “has a deadline of 14 days to exercise its right of withdrawal without having to give any reasons or incoming penalties, except, if necessary, return costs.” “The period mentioned in the foregoing paragraph shall begin to run following the reception of the products.”

The right of withdrawal can be exercise, within 14 days from reception of the order, by contacting

The Customer must indicate the following information:

  • Designation of the concerned products
  • Order number
  • Date of order
  • Date of delivery
  • Name
  • Address
  • Date
  • Motive ( optional )

Under article L.121-28 of the Consumer Code, the right of withdrawal cannot apply to some products such as CR-ROM and periodicals. If the Customer exercises his right of withdrawal within the above deadline, he will only be reimburse of the products costs and shipping fees. The return fees are the responsibility of the Customer. Products must be returned with a copy of the proof of purchase at: EFEO, 22 avenue du Président Wilson 75116 Paris.

Products must be returned in their original state and packaging so they can be sale again as new.

Once EFEO receives the returned products, the costs and the shipping fees will be re-credited on the Customer’s bank account regardless of the payment method chosen to make the order. If necessary, EFEO shall send back the new product.

Article 12: Warranties

According to the French law, EFEO provides a warranty of conformity , and a warranty against the latent defect. EFEO reimburse or exchanges any defective products or any products that would not correspond to the order made. Reimbursement or exchange requests must be submitted by mail at EFEO Service Diffusion, 22 avenue du Président Wilson 75116 Paris ou by email at efeo-diffusion@efeo.net.

The products must be sent back as tracked postal parcels (return costs are the responsibility of customer. The return must be made within the time frame prescribed by law. Bank details ( IBAN & BIC) must be provided to proceed with a reimbursement.

EFEO reminds that:

  •  the Customer has a deadline of two years, from the delivery of products, to act towards EFEO.
  • Subject to the conditions in Article…., the Customer can choose between the replacement or the repair of the product, if it is defective or non-corresponding to the order made.
  • The Customer is exempted from proving the conformity defect of the products during the six months following the delivery.
  • Except for second-hand goods, this period will be extended to 24 months from March 18th 2016
  • The Customer can enforce the guarantee of latent defects under article 1641 of the French Civil code. In this case, he can choose between the cancellation of the sale or a reduction of the selling price (art. 1644 of the French Civil Code)
Article 13: Claims

When appropriate, the Buyer can submit any claims by mail at Service Diffusion 22 avenue du Président Wilson, 75116 Paris or by email at efeo-diffusion@efeo.net.

Article 14: Intellectual property

Brands, domain names, products, software, images, vides, texts or any information submitted to intellectual property are and remain the exclusive property of EFEO. This contract does not assign any intellectual property rights to the elements belonging to EFEO. Any reproduction, total or partial, any modification or use of these properties for any reason whatsoever is strictly forbidden.

Article 15: Force majeure

The performance of EFEO’s obligations, regarding these General Terms and Conditions of Sale, is suspended if it is prevent by a fortuitous event or in case of force majeure. EFEO will inform the Customer as soon as possible if such an event occurs.

Article 16: Nullity

If a condition of the present contract was to be annulled,  this nullity would not lead to the nullity of the others stipulations which will remain in effect between the parties involved.

Article 17: Confidential information

In accordance with the data protection act, Loi Informartique et Libertés du 6 janvier 1978, the Customer has rights of interrogation, access, modification, opposition and rectification of its personal data. Upon acceding to these General Terms and Conditions of Sale, the Buyer consents to the collect and use of its data for the realization of the following contract. By entering his email address on EFEO Publications website, the Customer will receive emails containing information about products published by EFEO. He can unsubscribe at any time by sending an email at efeo-diffusion@efeo-net. EFEO uses cookies to monitor web traffic on the EFEO Publications website.

Article 18: Exclusion of liability

EFEO is not responsible for the publications contents and shall not be held liable by the Buyer. The proposed publications comply with the French legislation in force. EFEO declines any responsibility if the delivered product does not respect the legislation of the country of delivery (censorship, title ban, author ban). EFEO is not to blame for the non-performance of the contract in case of unavailable products or short stockage, total or partial strike of the delivery services, force majeure, flood or fire, etc.

Article 19: Applicable law

 All clauses of these General Terms and Conditions of Sale are submitted to the French law, as well as all purchases and sell transactions.
